By accessing or using the website at pittsfieldconcretecompany.com, or by engaging Pittsfield Concrete Company to perform any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or engage our services.
Pittsfield Concrete Company provides residential and commercial concrete contracting services in Pittsfield, MA and surrounding areas. Services include, but are not limited to, concrete driveways, patios, sidewalks, foundations, floors, pool decks, retaining walls, steps, and related concrete work. All services are subject to a written estimate and signed agreement prior to work beginning.
Estimates provided by Pittsfield Concrete Company are based on the information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated in writing. Estimates are not binding contracts.
A written contract or work order will be provided before any work begins. The final price may differ from the estimate if unforeseen site conditions are discovered - for example, if soil or sub-base conditions require additional excavation or base material. Any changes to scope or price will be communicated to you in writing before additional work proceeds.
Material prices are subject to market fluctuation. If the cost of materials changes significantly between estimate and project start, we will notify you before beginning work.
Project start dates are scheduled based on crew availability, permit timelines, and weather conditions. Concrete work cannot be performed in freezing temperatures or when rain is expected during or immediately after the pour. We will notify you as early as possible if a start date needs to change due to weather or other circumstances beyond our control.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice after materials have been ordered or a concrete truck has been scheduled may result in a cancellation fee to cover non-recoverable costs. The specific amount, if any, will be stated in your written contract.
We reserve the right to cancel or reschedule a project if site conditions on the scheduled day are unsafe or otherwise unsuitable for concrete work.
Payment terms for each project will be stated in the written contract. A deposit may be required prior to the start of work. The remaining balance is due upon completion of the project unless otherwise agreed in writing.
Accepted payment methods will be specified in your contract. Invoices not paid within the timeframe specified in the contract may be subject to a late fee. Pittsfield Concrete Company reserves the right to suspend work on projects where payment is overdue.
Title to any materials installed on your property does not transfer until full payment has been received.
Pittsfield Concrete Company will obtain any required permits for work performed under a signed contract, unless the parties agree otherwise in writing. Permit fees are the responsibility of the customer and will be included in the project quote. The customer is responsible for ensuring that any work performed on their property complies with local zoning ordinances, homeowner association rules, and any other restrictions specific to their property.
Pittsfield Concrete Company warrants that all work will be performed in a workmanlike manner consistent with industry standards for concrete construction in cold-weather climates. Any warranty terms specific to your project will be stated in your written contract.
Concrete is a natural material and some surface cracking over time is normal and expected, particularly in climates with significant freeze-thaw cycles. Minor hairline cracks that do not affect structural integrity are not considered defects.
Warranty coverage does not apply to damage caused by misuse, neglect, acts of nature, improper care (including use of chemical de-icers not recommended by the contractor), or modifications made by third parties after project completion.
To the maximum extent permitted by applicable law, Pittsfield Concrete Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to any project or use of this website, even if advised of the possibility of such damages.
Our total liability for any claim arising from a project shall not exceed the amount paid by the customer for that project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

Any legal action arising from these terms or from services provided by Pittsfield Concrete Company shall be brought exclusively in the courts of Massachusetts.
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective when posted to this page with an updated effective date. Your continued use of this website or engagement of our services after any changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
